| Pacquiao’s alleged bodyguard sues Roach |

Roach is due in court on March 3 for a conference management hearing of a civil case filed against him by Gregorio Asuncion, who is reported to be a member of Team Pacquiao, and his wife, Allyson, before the Superior Court of Los Angeles in California. The case grew out of an alleged mauling incident inside Roach’s owned Wildcard Boxing Gym in Los Angeles last October 20, 2008. Judge Kenneth Freeman will preside over the case. Court records showed that Roach and 100 other John Does are named in an “unlimited civil case" for damages ranging from assault, battery, intentional and negligent inflictions of emotional distress, negligence, premises liability and loss of consortium by the Asuncions, both residents of Los Angeles county. The 19-page, seven-count complaint was filed by the Asuncions’ lawyer Robert H. McNeill, Jr. last November 5, 2008. It said that on October 20, 2008, Asuncion had just dropped Pacquiao from the airport to the Wildcard Gym when Roach and a number of his wards “intentionally, willfully, wantonly and maliciously threatened to harm him." “Because of defendant’s (Roach’s) skill as a boxer and his occupation as a boxing trainer a reasonable person in Plaintiff’s situation would have been offended by the threat of violence by Roach", the complaint said. Roach reportedly asked the 51-year old Asuncion to get out of the gym because he does not want too many people inside. When he was about to leave, Roach allegedly hit him at the nape causing him to fall face first on the floor. He managed to get up and headed for the door where he felt dizziness. Asuncion then overheard Roach’s staff saying that he was acting he then called 911 for help and paramedics and police arrived shortly. He was put on a stretcher and given a neck brace before being taken to the hospital. As a result, Asuncion said he can no longer perform his job, which was not mentioned in the complaint. Asuncion, said to be 51-years old, also suffered “serious emotional distress" and also alleged that he “has been unable to perform the necessary duties as a spouse." Roach did not respond to an email requesting for comment while messages left on the voice mail of Asuncion’s lawyer, Robert H. McNeil, was also not returned. |
